ECM Re-flashing and the DMCA

Todd, I was wondering what your views were on the DMCA thing that is stirring right now. John Deere, General Motors and other manufacturers lobbying the government to stop people from modifying their vehicles using the Digital Millennium Copyright Act as a way to protect their intellectual property.

Of course I don't like it for many reasons, mainly that you have to count on a dealer always, which isn't bad when you're under warranty, but what happens when the vehicle is say 10+ years old. We all know how much fun that is. Secondly, no matter what they do, someone will be able to hack it. ;)
 
Interesting concept, though normally the for-profit modifications are an improvement to the base design/functionality and not a case where someone is repurposing the IP as a baseline/new product. I can see where big brother would get behind this a further means to clamp down on emissions regulations. At the risk of cutting into Todd's fine service, perhaps manufacturers should push back and lobby for the ability to deliver better running vehicles off the showroom floor.

I wasn't one to pursue fueling mods until I experienced the wonder of Todd's magic....
 
My opinion is that I've purchased the hardware (ECU, chip) and the software (fuel map) and I should be able to modify either as I want to. Relating this to the DMCA, if I buy a song off iTunes, I can then sample it, mix it, shorten it, move it from one device to another, etc. to fit my needs / desires.

I don't disagree with the concept that altering a fuel map will invalidate the engine warranty, but that should not affect the warranty for suspension or final drive.

If manufacturers delivered good fueling up front, there would be no market for reflashes, power commanders, or other modifications. I would love a well-fueling bike that lets me switch between performance and economy on the fly; not just less horsepower, but different engine characteristics depending on what I want to accomplish.
 
I hate the whole idea. Step: 1 "We can't have you playing with the fueling. It will pollute the air". Step: 2 we can't have you choosing to change the suspension, you may make the unit unsafe" Step: 3 "You are not smart enough to know which tires are best". Etc. Until you just pay for something that will take you there with no input from you and no modifications from you. It is coming but I am pushing back as much as possible. The dealers and manufacturers want it because the money goes to them and not the little guy.
